Terms of Service

1. Definitions

In these Terms of Service ("Terms"), the following definitions apply:

• "Platform", "Service", "Services", "LookArt.ai", "we", "us", or "our" refers to the LookArt.ai platform and all related services, features, content, and applications.
• "User", "you", or "your" refers to any individual or entity that accesses or uses the Services.
• "Account" means your registered user account on LookArt.ai.
• "Content" means any text, images, videos, audio, code, or other materials.
• "Input" or "User Input" refers to images, videos, or other content you upload to the Platform for processing.
• "Output" or "AI Output" refers to the AI-generated images or videos produced by the Platform using your Input.
• "Credits" means the virtual currency used to pay for generation tasks on the Platform.
• "Subscription" or "Plan" refers to a recurring payment arrangement that provides you with Credits and/or access to features.
• "Templates" refers to pre-configured AI generation workflows available on the Platform.
• "Third-Party Providers" refers to external AI service providers (such as Kling AI) whose APIs we use to generate Content.

2. Acceptance of Terms

By creating an Account, accessing, or using any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Acceptable Use Policy. If you do not agree to these Terms, you must not use the Services.

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. You are responsible for reviewing these Terms periodically.

3. Eligibility and Account

3.1 Age Requirement. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an Account and use the Services. If you are under 18, you may only use the Services with the involvement and consent of a parent or legal guardian.

3.2 Account Registration. To use generation features, you must create an Account by providing accurate and complete information. You may browse Templates without an Account, but generation requires authentication.

3.3 Account Security. You are responsible for maintaining the confidentiality of your Account credentials. You agree to notify us immediately of any unauthorized use of your Account. We are not liable for any loss or damage arising from your failure to protect your Account information.

3.4 One Account Per User. You may only maintain one Account. Creating multiple Accounts to circumvent usage limits or for any abusive purpose is prohibited.

4. Description of Services

LookArt.ai is a software-as-a-service (SaaS) platform that enables users to generate AI-powered images and videos. The Services include:

• Template Library: A collection of pre-configured AI generation workflows (Templates) that users can browse and use.
• Content Generation: Users upload Input (1–4 images or 1 short video up to 10 seconds) and select a Template. The Platform processes the Input using Third-Party AI Providers to generate Output.
• Credit-Based Usage: Generation tasks consume Credits. Users purchase Credits via one-time payments or recurring Subscriptions.
• Account Management: Users can manage their Account, view generation history, and manage Subscriptions.

The Platform relies on Third-Party Providers (such as Kling AI) to perform the actual AI processing. We integrate these providers' APIs but do not control their underlying technology or availability.

5. Credits and Subscriptions

6. Payments and Billing

6.1 Payment Processing. Payments are processed by a third-party merchant of record (e.g., Paddle, Stripe, or similar). By providing payment information, you authorize the merchant and us to charge your payment method for all fees incurred.

6.2 Pricing. All prices are stated in U.S. dollars (or the currency specified at checkout) and are subject to change. We will notify you of price changes in advance for Subscription renewals.

6.3 Taxes. Prices may not include applicable taxes (such as VAT, GST, or sales tax). You are responsible for any taxes imposed by your jurisdiction. Our merchant of record may collect taxes on our behalf where required.

6.4 Failed Payments. If a payment fails, we may retry the charge. Continued failure may result in suspension or termination of your Account. You remain liable for any outstanding amounts.

6.5 Chargebacks. Initiating a chargeback without first contacting us may result in immediate Account suspension and forfeiture of Services. Unjustified chargebacks may lead to permanent Account termination.

7. Refund Policy

Due to the digital and consumption-based nature of the Services, all purchases of Credits and Subscriptions are generally non-refundable. Once Credits are consumed (i.e., used to generate Output), they cannot be refunded.

In exceptional cases where required by applicable consumer protection law, we may offer refunds at our sole discretion. If you believe you are entitled to a refund, contact support@lookart.ai with your Order ID and reason. We will review your request on a case-by-case basis.

This refund policy does not affect your statutory rights as a consumer under applicable law.

8. User Input and AI Output

8.1 Ownership of Input. You retain all ownership rights in your User Input. By uploading Input to the Platform, you grant us a limited, non-exclusive, worldwide license to use, store, and process your Input solely for the purpose of providing the Services (i.e., generating Output).

8.2 AI Output. AI-generated Output is provided "as is." While we strive for quality, AI systems may produce unpredictable results, including outputs that resemble existing works or contain unintended artifacts.

8.3 Responsibility for Use. You are solely responsible for your use of Output. You must ensure that your use complies with applicable laws, including intellectual property and privacy laws. We do not claim ownership of Output, but we also do not guarantee that Output is free from third-party rights.

8.4 No Warranty on Originality. AI-generated content may inadvertently resemble existing copyrighted works. We do not warrant that Output is original or free from infringement claims. You assume all risks related to the use of Output.

9. Intellectual Property

9.1 Platform IP. The Platform, including its software, design, Templates, user interface, and all related intellectual property, is owned by LookArt.ai or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms. You may not copy, modify, distribute, or reverse-engineer any part of the Platform.

9.2 Templates. Templates are proprietary works created by us or licensed from third parties. By using a Template, you receive a limited license to use it for generating Output, but you do not acquire ownership of the Template itself.

9.3 Trademarks. "LookArt.ai," our logo, and related marks are trademarks. You may not use our trademarks without prior written consent.

10. Prohibited Content and Conduct

You agree not to use the Services to create, upload, or share Content that:

• Is illegal, fraudulent, or violates any applicable law.
• Infringes on intellectual property rights, including copyrights, trademarks, or patents.
• Contains explicit sexual content, pornography, or content involving minors in any sexual or exploitative context (strictly prohibited).
• Promotes violence, terrorism, hate speech, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Harasses, threatens, or intimidates individuals or groups.
• Impersonates another person or entity, or misrepresents your affiliation with any person or entity.
• Contains malware, viruses, or any code intended to damage or disrupt systems.
• Involves the creation of deepfakes or misleading content intended to deceive or defraud.
• Violates the privacy or publicity rights of others.

You also agree not to:

• Abuse, exploit, or circumvent the Platform's technical limitations or security measures.
• Use automated tools (bots, scrapers) to access the Services without authorization.
• Resell, redistribute, or commercialize the Services without a written agreement.
• Attempt to reverse-engineer, decompile, or extract source code from the Platform.

11. Content Moderation and Safety

We reserve the right to review, monitor, and moderate User Input and Output (both automatically and manually) to ensure compliance with these Terms and applicable law. We may use automated systems, third-party moderation services, and human review.

If we determine that Content violates these Terms, we may remove the Content, suspend or terminate your Account, and report illegal activity to authorities. We are not obligated to monitor Content but reserve the right to do so.

We do not pre-screen all Content, and we are not responsible for User-generated Content. However, we take safety seriously and will act on reports of abuse.

12. Third-Party Providers

The Services rely on Third-Party Providers (such as Kling AI) for AI processing. These providers have their own terms, policies, and service limitations. We integrate their APIs but do not control their operations, availability, or results.

Third-Party Provider outages, rate limits, or changes to their services may affect the availability or quality of the Services. We are not liable for any issues arising from Third-Party Providers.

By using the Services, you acknowledge and agree that your Input may be processed by Third-Party Providers in accordance with their policies.

13. Service Availability

We strive to provide reliable, high-quality Services, but we do not guarantee uninterrupted or error-free access. The Services are provided on an "as available" basis.

We may experience downtime for maintenance, upgrades, or due to factors beyond our control (e.g., Third-Party Provider outages, internet disruptions). We will make reasonable efforts to notify you of scheduled maintenance, but we are not liable for any downtime.

We do not provide a Service Level Agreement (SLA) for uptime. Use of the Services is at your own risk.

14. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
• Warranties that the Services will meet your requirements, be uninterrupted, timely, secure, or error-free.
• Warranties regarding the accuracy, reliability, or quality of Output.

No advice or information obtained from us or through the Services creates any warranty not expressly stated in these Terms.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LOOKART.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, revenue, data, or use.
• Cost of procurement of substitute services.
• Business interruption or loss of goodwill.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

IN ANY CASE, OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law.

16. Indemnification

You agree to indemnify, defend, and hold harmless LookArt.ai, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Services or violation of these Terms.
• Your User Input or Output, including any third-party claims of infringement or violation of rights.
• Your violation of any law or regulation.
• Any claim that your Input or use of Output caused harm to a third party.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with our defense.

17. Termination

17.1 Termination by You. You may terminate your Account at any time by contacting support@lookart.ai. Upon termination, you will lose access to your Account, Credits, and generation history. No refunds will be provided for unused Credits or remaining Subscription periods, except as required by law.

17.2 Termination by Us. We may suspend or terminate your Account immediately, without prior notice, if:

• You violate these Terms, our Acceptable Use Policy, or any applicable law.
• Your Account is involved in fraudulent, abusive, or harmful activity.
• We are required to do so by law or court order.
• We decide to discontinue the Services (with reasonable notice where feasible).

17.3 Effect of Termination. Upon termination, your license to use the Services immediately ends. Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will continue to apply.

18. Changes to Terms

We may modify these Terms at any time. When we do, we will post the updated Terms on this page and update the "Last Updated" date. If changes are material, we will provide additional notice (such as an email notification or in-app message).

Your continued use of the Services after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services and may terminate your Account.

19. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where LookArt.ai is established, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Services shall be resolved in the courts of that jurisdiction, and you consent to the exclusive jurisdiction and venue of such courts.

Nothing in these Terms limits your rights as a consumer under mandatory applicable law.
